Judge rules after 'Dateline' leak in Kohberger case, demands source probe

Ada County District Court Judge Steven Hippler has issued a new ruling following an episode of "Dateline" in which previously undisclosed information was aired.

In the ruling, Judge Hippler says the information must have come from someone currently or formerly involved in law enforcement or the prosecution of this case. A gag order was issued early on in the case against Bryan Kohberger, the man accused of murdering four University of Idaho students in their off-campus home.

The gag order covers all members of law enforcement, the prosecution, those affiliated with this case, and even the victim's families.

The Dateline episode in question revealed previously unknown things about the case, things Judge Hippler says are a direct violation of the gag order, and could severely impact the ability to seat an impartial jury.

As part of the order issued by Judge Hippler, he instructed the prosecution to compile a complete list of everyone who has had access to the details of this case to be turned over within seven days. The order also instructs prosecutors to come up with a plan on how to prevent any further leaks and how to root out the source of this leak. Anyone who has been involved in this case through law enforcement or the prosecution has been ordered to keep all records and recordings and not delete anything.
